<p>These Terms and Conditions govern the use of the mobile application <strong>Hair Scan AI</strong> (the "Application"), developed by <strong>DoubleE Studio</strong> and created by <strong>Michele Cipriani and Tommaso Vilotto</strong> (the "Service Provider").</p>
<h2>1. Acceptance of Terms</h2>
<p>By downloading, installing, or using the Application, you agree to be bound by these Terms and Conditions in full. Access to core app functionality is subject to explicit in-app acceptance of these Terms.</p>
<p>If you do not accept these Terms, you must not access or use the Application.</p>
<h2>2. Nature of the Service</h2>
<p>The Application provides a <strong>preliminary and indicative</strong> scalp analysis through photographic image processing and AI services (Google Gemini API).</p>
<p>The Application is not intended for clinical practice, medical-device-regulated workflows, or professional medical decision-making.</p>

The Application does NOT provide medical diagnosis, clinical advice, or professional healthcare services. Scan results are purely <strong>informational and subjective</strong> and are not a substitute for medical consultation.<br><br>
For any scalp or hair health concern, you should consult a qualified dermatologist or trichologist.<br><br>
The Service Provider disclaims liability for user decisions made solely on the basis of app-generated results.

<h2>3. App Flow and Main Features</h2>
<p>The Application includes the following flow and features:</p>
<ul>
<li><strong>Initial onboarding:</strong> optional contextual questions (age, sex, possible health concerns). This data is not stored in our database.</li>
<li><strong>Access options:</strong> continue with Google, continue with Apple ID, or continue without account.</li>
<li><strong>Terms acceptance:</strong> users must accept these Terms before proceeding to scan features.</li>
<li><strong>Scalp scan:</strong> the user captures 4 scalp photos and starts the scan process.</li>
<li><strong>Ad-based unlock steps:</strong> some features (including scan unlock flows) may require viewing rewarded ads through Google AdMob.</li>
<li><strong>AI processing:</strong> photos are processed through Google Gemini API to generate a non-medical, indicative analysis.</li>
<li><strong>Home area:</strong> users can log hair-care products, review past scans (if account-based), and run new scans.</li>
</ul>
<h2>4. Age Requirement</h2>
<p>Use of the Application is restricted to users who are at least <strong>18 years old</strong>. Users under 18 are not authorized to use this service.</p>
<h2>5. User Accounts</h2>
<p>You may choose to:</p>
<ul>
<li>Use the Application <strong>without an account</strong> (limited mode, no account-linked history persistence)</li>
<li>Authenticate via <strong>Google</strong> or <strong>Apple ID</strong> for account-based features</li>
</ul>
<p>You are responsible for safeguarding your Google/Apple access credentials. The Service Provider does not store your provider password.</p>
<h2>6. Photo Use and Processing</h2>
<p>Scalp photos taken through the Application are:</p>
<ul>
<li>Processed temporarily and sent to Google Gemini API</li>
<li>Not permanently stored on Service Provider servers</li>
<li>Removed from temporary memory after results are generated</li>
</ul>
<p>You represent that you have the right to capture and submit the uploaded images and that they do not infringe third-party rights.</p>
<h2>7. Advertising and Credits</h2>
<p>The Application uses <strong>Google AdMob</strong> to display ads. Some features can be unlocked through rewarded ads. Ad viewing and ad data handling are subject to Google policies and, where required, user consent settings.</p>
<p>The in-app coin/credit system is managed internally for feature unlock logic.</p>
<h2>8. Connectivity and Data Usage</h2>
<p>An active internet connection is required for core operations, including AI scan processing, ad delivery, and account synchronization.</p>
<p>You are responsible for carrier/mobile data charges and connectivity limitations.</p>
<h2>9. Intellectual Property</h2>
<p>All intellectual property rights related to the Application, including code, design, branding, and content, belong to the Service Provider and/or its licensors.</p>
<p>You may not:</p>
<ul>
<li>Copy, modify, distribute, or commercially exploit the Application</li>
<li>Reverse engineer, decompile, or attempt to extract source code except where permitted by mandatory law</li>
<li>Remove legal notices or trademarks</li>
<li>Use the Application for unlawful purposes</li>
</ul>
<h2>10. Third-Party Services</h2>
<p>The Application integrates third-party services, including:</p>
<ul>
<li><strong>Google Gemini API</strong> for AI image analysis</li>
<li><strong>Google AdMob</strong> for ads and reward ad flows</li>
<li><strong>Google Sign-In</strong> for authentication</li>
<li><strong>Apple Sign-In</strong> for authentication</li>
<li><strong>Supabase</strong> as backend database and infrastructure provider — stores account data, coin/credit balances, and scan timestamps (date/time only)</li>
</ul>
<p>Use of third-party services is governed by their respective terms and privacy policies.</p>
<p>The Application uses Google Gemini API in paid service mode, and related data handling is governed by the applicable Google contractual terms for that mode.</p>
<h2>11. Limitation of Liability</h2>
<p>The Application is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind.</p>
<p>To the maximum extent permitted by law, the Service Provider is not liable for indirect, incidental, special, or consequential damages arising from use of the Application, including reliance on AI-generated outputs.</p>
<p>Nothing in these Terms excludes or limits liability that cannot be excluded by mandatory law, including liability for willful misconduct, gross negligence, personal injury, or fraud where applicable.</p>
<p>Nothing in these Terms limits mandatory consumer rights under applicable law.</p>

<strong>Note:</strong> AI systems can produce inaccurate, incomplete, or misleading outputs. Results must be interpreted critically and do not replace professional healthcare advice.
</div>
<h2>12. Account Deletion</h2>
<p>You can delete your account at any time from the Application settings.</p>
<p>Deletion results in:</p>
<ul>
<li>Permanent deletion of your user ID, email, and coin balance from our servers</li>
<li>Removal of scan timestamps from our database</li>
<li>Retention of minimal Terms acceptance log (timestamp and version only) for up to 10 years for legal defense purposes, as permitted under applicable law</li>
<li>Scan history and product logs remain on your device until app uninstallation or manual deletion</li>
<li>No ability to recover deleted account data</li>
</ul>
<h2>13. Service Changes</h2>
<p>The Service Provider may modify, update, suspend, or discontinue the Application (or parts of it) at any time, including feature availability and monetization logic.</p>
<h2>14. Distribution Platforms</h2>
<p>The Application is distributed through the Apple App Store. Your use may also be subject to Apple's App Store terms.</p>
<h2>15. Changes to These Terms</h2>
<p>These Terms may be updated periodically. Material changes may be communicated through in-app notices or email (if available). Continued use of the Application after such updates constitutes acceptance of the revised Terms.</p>
<h2>16. Governing Law</h2>
<p>These Terms are governed by the laws of Italy, without prejudice to mandatory consumer protection rights that may apply under the laws of your country of habitual residence.</p>
<p>For users acting as consumers, any dispute may also be brought before the competent courts under applicable mandatory consumer law. For non-consumer users, unless otherwise required by law, disputes are submitted to the competent courts of Italy.</p>
