Welcome to PocketVibe, developed and distributed by Ivy Apps Ltd (“we,” “our,” or “us”), a company registered in Bulgaria. By downloading, accessing, or using PocketVibe ("App"), you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
By using the App, you confirm that you are at least 18 years old or have obtained verifiable parental consent. You agree to be legally bound by these Terms and our Privacy Policy, which governs data collection practices including via Firebase Analytics and Firebase Crashlytics.
- The App connects to third-party large language models (LLMs) via an API key provided and owned by you.
- The API key is stored locally on your device and is never transmitted to or stored by Ivy Apps Ltd.
- You are solely responsible for:
- The security, confidentiality, and integrity of your API key.
- Rotating the key periodically and monitoring for abuse.
- Ensuring the legal, ethical, and safe use of the LLMs.
- Paying all charges, overages, or third-party fees associated with LLM API usage.
- Ivy Apps Ltd strongly recommends using LLM API keys with rate limiting and spending caps to prevent unexpected charges. Ivy Apps Ltd is not responsible for charges incurred due to the user's failure to implement these safeguards.
- The user acknowledges that the LLMs are constantly evolving, and Ivy Apps Ltd is not responsible for changes in LLM behavior or output quality.
- For enhanced security and to prevent unexpected charges, Ivy Apps Ltd strongly recommends that you create a separate API key specifically for use with PocketVibe. This dedicated API key should have strict usage limits and spending caps configured through your LLM service provider. Avoid using your primary or high-limit API key with PocketVibe.
- You are solely responsible for ensuring the legal, ethical, and safe use of the LLMs, and you agree to indemnify and hold Ivy Apps Ltd harmless from any claims arising from your use of the LLMs. Ivy Apps Ltd is not liable for any loss, misuse, or leakage of your API key. You use it at your own risk.
- The App offers a one-time in-app purchase on Google Play to unlock its base features.
- This purchase does not include:
- Future updates or new features.
- Desktop or web versions of PocketVibe.
- Any costs associated with LLM API usage or third-party services.
Your purchase unlocks only the current Android version, delivered "as is" and "with all faults."
Refund Policy: All purchases are final and non-refundable unless required by applicable law.
- The AI features provided through third-party APIs may generate inaccurate, offensive, or unpredictable outputs.
- We make no guarantees regarding the accuracy, reliability, legality, or safety of any generated content.
- You acknowledge and agree that:
- All outputs are automated and not human-reviewed.
- You are solely responsible for reviewing and using any AI-generated content.
- You must not rely on the AI for legal, medical, financial, or professional advice.
- Users are advised to critically evaluate all AI-generated content and not use it as a substitute for professional advice. Ivy Apps Ltd is not responsible for any consequences resulting from the use or misuse of AI-generated content.
- Ivy Apps Ltd does not endorse or approve any AI-generated content. The views and opinions expressed in AI-generated content do not necessarily reflect those of Ivy Apps Ltd.
- We use Firebase Analytics and Firebase Crashlytics to gather anonymized performance and diagnostic data.
- By using the App, you consent to this data collection in accordance with our Privacy Policy.
- The anonymized data collected by Firebase Analytics and Crashlytics is used solely for improving the App's performance and stability. Ivy Apps Ltd does not attempt to identify individual users from this data.
- Ivy Apps Ltd uses industry-standard practices for anonymizing data but cannot guarantee absolute anonymity. The user accepts this inherent risk by using the App.
You agree not to:
- Use the App or AI features for unlawful, harmful, or deceptive purposes.
- Transmit or input sensitive, confidential, or personally identifiable information.
- Attempt to reverse engineer, tamper with, or circumvent access controls.
We may terminate your access to the App without notice if you violate these Terms or applicable laws.
The App is provided on an "as is", "as available", and "with all faults" basis. To the fullest extent permitted by law, Ivy Apps Ltd disclaims all warranties, including:
- Merchantability or fitness for a particular purpose.
- Accuracy or reliability of outputs.
- Continuity of service or updates.
- Error-free or uninterrupted operation.
- Security against vulnerabilities or data loss.
- Due to the complex nature of software and AI technology, Ivy Apps Ltd cannot guarantee that the App will be error-free or uninterrupted. The user acknowledges this limitation and accepts the App's functionality on an 'as is' basis.
We are not responsible for:
- Bugs, glitches, or crashes.
- AI output errors.
- API key loss or misuse.
- Any third-party charges, costs, or fees caused by your usage, your API key, or any integration with third-party services.
You bear full responsibility for all costs incurred through your use of the App and connected LLM APIs.
To the maximum extent permitted by law, Ivy Apps Ltd shall not be liable for:
- Indirect, incidental, special, or consequential damages.
- Lost data, profits, or goodwill.
- AI-generated harm or misuse of outputs.
- Unauthorized access to or alteration of your data.
- Any charges or losses related to third-party services, including LLM API usage.
- To the fullest extent permitted by law, Ivy Apps Ltd's liability is limited to direct damages only. Ivy Apps Ltd shall not be liable for any indirect, incidental, consequential, or punitive damages, even if Ivy Apps Ltd has been advised of the possibility of such damages.
- In jurisdictions where limitations on liability are not permitted, Ivy Apps Ltd's liability shall be limited to the minimum amount permitted by law.
Our total liability shall not exceed the amount you have paid us via Google Play in the 12 months preceding the claim.
All rights, titles, and interests in the App (excluding third-party APIs and generated outputs) are owned by Ivy Apps Ltd. You may not reproduce, modify, distribute, or create derivative works without our prior written consent.
You may stop using the App at any time. We reserve the right to suspend or terminate access at our discretion if you breach these Terms.
These Terms shall be governed by the laws of Bulgaria. Any disputes shall be subject to the exclusive jurisdiction of the Bulgarian courts. Nothing in these Terms limits your rights under consumer protection laws of your local jurisdiction if applicable.
We may modify these Terms from time to time. Significant changes will be communicated through the App or via email with at least 30 days’ notice. Your continued use after the effective date constitutes your acceptance of the revised Terms.
- The user is responsible for checking for updates to the ToS periodically. While Ivy Apps will provide 30-day notice, it's the user's responsibility to stay informed.
