1. Definitions
- "Software" means the entire project, including but not limited to the source code, files, data structures, assets, documentation, configurations, and any associated materials.
- "Derivative Works" means any work that is based upon, adapted from, integrated with, or incorporates components of the Software.
- "Owners" refers to the original creators and current main maintainers of the Software who hold authority over licensing and distribution.
- "User" means any individual, group, or organization that accesses, installs, uses, modifies, copies, or distributes the Software or any portion of it.
2. Permissions
Permission is granted, free of charge, to any User obtaining a copy of the Software, to:
a) Use the Software strictly for personal, educational, research, or non-commercial experimentation.
b) View, study, and explore the source code for learning or debugging purposes.
c) Propose contributions via pull requests, issues, or suggestions for improvement.
d) Modify the Software for personal use only, without redistribution.
3. Restrictions
The User MAY NOT, without prior explicit written authorization from the Owners:
a) Use the Software, or any part of it, for commercial, promotional, or revenue-generating activities.
b) Distribute the Software (modified or unmodified) through any medium, platform, or repository.
c) Develop, release, or contribute to Derivative Works that closely replicate the Software’s core features, purpose, or functionality.
d) Rebrand, relicense, or claim ownership of any portion of the Software.
e) Misrepresent affiliation with or endorsement by HacktoberWall or its maintainers.
f) Incorporate the Software into any project involving AI model training, surveillance systems, or military applications.
4. Attribution Requirements
If express permission is granted for Derivative Works or redistribution, the following conditions apply:
a) The original project (HacktoberWall) must be clearly credited in the README, documentation, and source files.
b) The original license, copyright, and notices must remain intact.
c) A changelog or clear note must identify all modifications made.
d) Any public forks or reuploads must include a visible link to the original repository.
5. Contributions
a) All contributions submitted to the official repository or development channel are subject to review and final approval by the Owners.
b) By contributing, the contributor grants the Owners a non-exclusive, worldwide, royalty-free, perpetual license to use, modify, sublicense, and distribute the contribution as part of the Software.
c) The contributor retains ownership of their submitted code, but acknowledges it may be publicly listed, merged, or altered.
d) Contributors agree that their public name or handle may appear in project acknowledgments, changelogs, and contributor lists.
6. Warranty and Liability
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT ANY WARRANTY OR GUARANTEE OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
THE OWNERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
7. Data Privacy
The Software does not intentionally collect or process any personal data.
If future versions introduce data collection, a separate and clear Privacy Policy will be included.
By contributing to the project, Users consent to the public display of their username or chosen identifier unless they request anonymity in writing.
8. Termination
Any breach of this license immediately and automatically terminates all granted rights.
Upon termination, the User must stop using the Software and destroy all copies, including modified versions.
The Owners reserve the right to revoke access or ban contributions from any User violating community standards or license terms.
9. Jurisdiction and Dispute Resolution
This License is governed by and shall be interpreted under the laws of the United States of America.
Any legal disputes arising from this License shall be resolved in a U.S. court of competent jurisdiction, unless otherwise agreed upon in writing by both parties.
10. License Modification
The Owners may modify the terms of this license for future versions of the Software.
Changes will be documented and dated clearly. Prior versions remain valid under their original terms for copies obtained before the change date.
11. Miscellaneous
- This License constitutes the entire agreement between the User and the Owners regarding use of the Software.
- If any provision of this License is held to be unenforceable, the rest shall remain in effect.
- Failure to enforce any term shall not be considered a waiver of future enforcement.
- Any permissions not explicitly granted herein are reserved by the Owners.
