IMPORTANT NOTICE
This is a proprietary, source-available license. The source code is publicly visible for
transparency, evaluation and educational purposes, but its use is restricted as described
below. Any use beyond what is explicitly permitted requires a separate commercial license.

1) DEFINITIONS
“Software” means the Saberly project, including source code, documentation, assets, and
any related materials in this repository.
“Permitted Use” means the limited rights granted in Section 2.
“Commercial Use” means any use primarily intended for commercial advantage or monetary
compensation, including (but not limited to): using the Software in a company, selling
access, embedding in a paid product, or using it to deliver services to clients.
“Production Use” means use in a live environment serving real users, customers, students,
or internal operations of an organization (including intranet).
“Distribution” means sharing, publishing, sublicensing, selling, or otherwise making the
Software or a derivative available to third parties.

2) GRANT OF RIGHTS (NON-COMMERCIAL / EVALUATION ONLY)
Subject to the terms of this license, you are granted a limited, non-exclusive,
non-transferable, non-sublicensable right to:
(a) view and study the Software;
(b) run the Software locally for evaluation, learning, testing, or demonstration purposes
    (non-production, non-commercial);
(c) modify the Software for your own evaluation/learning purposes, provided that you do not
    use it in Production or for Commercial Use, and you do not Distribute it.

3) RESTRICTIONS
Unless you have an explicit written permission or a commercial license from the Licensor
(Felipe Jovino), you may NOT:
(a) use the Software in Production;
(b) use the Software for Commercial Use;
(c) Distribute the Software or any derivative works, in source or binary form;
(d) sell, license, rent, lease, or otherwise monetize the Software or derivatives;
(e) provide the Software (or a service based on it) to third parties, including as SaaS,
    hosted platform, consulting deliverable, or managed service;
(f) remove, alter, or obscure any copyright, license, or attribution notices.

4) OWNERSHIP
The Software is licensed, not sold. Felipe Jovino retains all right, title, and interest in
and to the Software. No rights are granted except as explicitly stated in this license.

5) CONTRIBUTIONS
If you submit a contribution (e.g., pull request, patch, suggestion), you agree that:
(a) you have the right to submit it; and
(b) you grant Felipe Jovino a perpetual, worldwide, irrevocable, royalty-free right to use,
    modify, relicense, and distribute your contribution as part of the Software under any
    terms, including proprietary and commercial terms.

6) TRADEMARKS
This license does not grant permission to use the “Saberly” name, logos, or branding for
promotion, marketing, or product naming without written permission.

7) COMMERCIAL LICENSING
If you want to use the Software in Production and/or for Commercial Use, you must obtain a
commercial license from the Licensor.

8) TERMINATION
This license is effective until terminated. Your rights under this license will terminate
automatically without notice if you violate any term. Upon termination, you must cease all
use of the Software and delete all copies in your possession or control.

9) DISCLAIMER OF WARRANTY
THE SOFTWARE IS PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED,
INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE AND NON-INFRINGEMENT. YOU BEAR ALL RISK OF USING THE SOFTWARE.

10) LIMITATION OF LIABILITY
IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY,
WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION
WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

11) GOVERNING LAW
This license shall be governed by the laws of Brazil, without regard to conflict of laws
principles. Any disputes shall be resolved in the competent courts of Brazil.
