The interim solution is to replace R1-R15 and R22 and R23 with 22K Ohm resistors and the LVC165s with HC165s if building a revF board.
The better solution is to use 74HC165s, feed them with Vcc=5V, and then put a single 5V->3.3V level shifter on the EXP_RDATA output (assuming that the 3.3V latch and shift inputs to 5V fed HC165s will will be operable.
