TOC: Group without direct child layers are not restored in the correct position #11395

Description
In the TOC, if a new group is created that has no direct child layers but contains subgroups with layers, the newly created group will not appear in its expected position after being saved.
How to reproduce
See the attached video.
Expected Result
The group test2 should appear between test1 and test3.
Current Result
The group test2 appears at the very bottom instead.
