Describe the issue

Public and open source contains header references to "confidential and proprietary" Microsoft code. Is this allowed? Should these headers be removed? Currently this flags a proprietary license occurrence in a ScanCode license check.

Scancode detected proprietary license within these two files:

onnxruntime/test/testdata/custom_execution_provider_library/my_execution_provider.cc
onnxruntime/test/testdata/custom_execution_provider_library/my_execution_provider.h

Please, just have a look into the two files provided. Troubling license statement is at the top of the page.
It states:
