contributors. The source code is licensed under the Mozilla Public
License, Version 2.0 - see the LICENSE file for full terms.
This NOTICE file documents additional branding terms that apply
alongside the source-code license. The two are deliberately separate:
* The LICENSE governs the CODE.
* This NOTICE governs the BRAND.
Read both before forking, redistributing, or derivative work.

1. BRAND IDENTITY

The following are the property of Noah Zeumer and constitute the brand
identity of the Testudo project:
(a) the name "Testudo", in any casing or stylization;
(b) the ASCII banner reproduced below and shipped throughout the
project's source and documentation;
(c) the visual and textual identity of the Testudo project,
including its tagline, color treatments, and any logo derived
from the ASCII banner;
(d) the URL slugs and project identifiers that uniquely refer to
Testudo as a product.

The MPL-2.0 grant on the source code does NOT extend to these brand
elements. They are licensed only on the terms set out in this NOTICE.

2. PERMITTED USES
--------------------------------------------------------------------------------
You are free, without separate permission, to:
(a) fork the repository and retain the Testudo name and banner so
long as the fork remains a fork - meaning it tracks the upstream
project, reasonably acknowledges that relationship, and presents
itself as a derivative of Testudo rather than a new product;
(b) reference the name "Testudo" in factual, descriptive contexts -
documentation, blog posts, comparison tables, talks, academic
work, or compatibility statements - without prior approval;
(c) distribute unmodified or minimally modified builds of Testudo
under the original name, provided this NOTICE file accompanies
the distribution and remains unaltered;
(d) ship Testudo as a component of a larger system or commercial
product, provided the Testudo branding is preserved within the
Testudo portion and attribution is given in your product's
documentation or about screen.

3. RESTRICTED USES
--------------------------------------------------------------------------------
The following uses require separate written permission from Noah Zeumer:
(a) releasing a substantively modified fork under the name
"Testudo" or any name confusingly similar to it;
(b) re-publishing the project under a different product name while
retaining the ASCII banner, identity, or marketing language of
Testudo as if to suggest authorship;
(c) reusing the ASCII banner as the identity of any product,
service, or organization other than Testudo, or any direct
derivative thereof that remains identified as Testudo;
(d) commercial use of the name "Testudo" or the banner in a way
that implies endorsement, affiliation with, or sponsorship by
Noah Zeumer or the Testudo project where no such relationship
exists;
(e) registering "Testudo" or a confusingly similar mark as a
trademark, domain name, package name, or service identifier in
a way that would interfere with the Testudo project's ability
to operate under its own name.

4. ATTRIBUTION REQUIREMENTS
--------------------------------------------------------------------------------
When redistributing Testudo, in source or binary form, you must:
(a) include a copy of this NOTICE file in the distribution;
(b) include a copy of the LICENSE file in the distribution;
(c) preserve all copyright headers in the source files you
redistribute;
(d) preserve the ASCII banner in any user-visible help, splash, or
"about" surface where it appears upstream, unless the form
factor genuinely precludes it.
When publishing a substantively modified derivative under a different
name (as Section 3(a) requires), you must:
(e) remove the Testudo ASCII banner and replace it with your own
identity;
(f) retain a short factual notice such as "Derived from Testudo by
Noah Zeumer - https://github.com/noahzmr/testudo" in your project's
documentation, README, or about screen;
(g) retain the copyright headers from any Testudo source files you
reuse, as MPL-2.0 requires.

5. REDISTRIBUTION RULES
--------------------------------------------------------------------------------
Source-form redistribution must satisfy both the MPL-2.0 conditions in
the LICENSE file and the attribution requirements in Section 4 of this
NOTICE.
Binary-form redistribution must satisfy MPL-2.0 Section 3.2 (Executable
Form) and additionally:
(a) preserve the project's name in user-facing surfaces unless the
derivative is renamed in full compliance with Section 3(a);
(b) make the corresponding source code available on the terms of
MPL-2.0;
(c) include this NOTICE file alongside the LICENSE.
Repackaging into operating-system package managers (apt, dnf, pacman,
Homebrew, Nix, etc.) is permitted without prior approval as long as the
package preserves the project name, the source remains available, and
this NOTICE and the LICENSE travel with the package.

6. TRADEMARK-STYLE PROTECTION
--------------------------------------------------------------------------------
The name "Testudo" and the ASCII banner are treated by Noah Zeumer as
trademark-equivalent brand identifiers, regardless of whether formal
trademark registration has been pursued in any jurisdiction.
Nothing in the MPL-2.0 grants any rights in these brand identifiers
beyond what is necessary to comply with the attribution and notice
requirements of that license (MPL-2.0 Section 2.3 last paragraph; this
NOTICE elaborates that reservation).
Any use of the brand identifiers outside the bounds of Sections 2 and 4
of this NOTICE requires prior written permission. Permission requests
should be directed to Noah Zeumer via the contact information on the
project's public repository.

7. AUTHORSHIP & MISREPRESENTATION
--------------------------------------------------------------------------------
You may not:
(a) misrepresent the origin of Testudo or of any code originating
from Testudo;
(b) remove or alter author attribution from individual source files
(this is also forbidden by MPL-2.0 Section 3.4);
(c) hold yourself out as the original author of Testudo or of any
substantial portion of it;
(d) imply that contributors, including Noah Zeumer, endorse a
derivative work, a fork, or a commercial offering when no such
endorsement has been given in writing.

8. SUMMARY (NON-BINDING)
--------------------------------------------------------------------------------
The plain-language version of this NOTICE, provided only for
convenience and subordinate to the binding text above:
Fork freely. Modify freely. Use it commercially. Build on it.
But: don't ship a substantively different product still calling
itself Testudo, don't strip the credit, don't reuse the banner as
some other thing's identity, and don't claim you wrote it.
If you change it enough that it isn't Testudo anymore, give it a
different name - and the code itself stays MPL-2.0 either way.
