Struggling with Nested TOC

Hey i am having trouble using toc from nuxt content module 3. Below is my implementation

  if (!post.value || !post.value.body || !post.value.body.toc) {

  }
})

The above function only gets h2 and very rarely gets h3. h1 is completely ignored all the times.
h3 is accessible in very rare cases such as I change headings structure to something like below:

Heading 1

Heading 3

Heading 3

if I place another h2 in between it wont get any of h3
